Trademark & Copyright Usage Guidelines

This Boulevard Marks Usage Agreement (“Agreement”) sets out the legal terms governing your ability to use the Boulevard name, logo, and other registered or unregistered Boulevard trademarks and service marks owned by Boulevard and its affiliates (“Boulevard Marks”) to let your customers know that Boulevard (“we”, “us”, “our”) provides services for your business. A list of the Boulevard Marks available for use can be found on our Brand Resources page. Your use of services provided by Boulevard is governed by the Boulevard Terms of Service (“Terms of Service”), and terms used but not defined in this Agreement have the meanings given in the Terms of Service.

You may not use any Boulevard Marks without having agreed to abide by all of the terms and conditions in this Agreement, and unless you do so in accordance with this Agreement.

1. Permission to Use Boulevard Marks Boulevard Marks are important assets of Boulevard’s business and are protected by US and international laws. You are licensed to use the Boulevard Marks as described in this Agreement on a non-exclusive, non-transferable basis on websites or applications that utilize the Services (as defined in the Terms of Service). However, your use is subject to the terms set out in this Agreement, and we may terminate your license via (i) our absolute ability to supervise, monitor, and revoke your license at any time and at our discretion, or (ii) your non-use or cancellation of the Services. Upon termination of the license, you agree to promptly remove any Boulevard Marks from any websites or applications, or other material within a reasonable time.

2. Proper Use of Boulevard Marks You may reference Boulevard’s products and services using the Boulevard trademarks, so long as such references are: (1) truthful, fair, and not misleading, and (2) comply with the below Trademark Usage Guidelines (“Guidelines”), which may be modified from time to time by Boulevard in its sole discretion. The Boulevard trademarks and brands should never be used in a way that could cause anyone wrongly to believe that your products or services are offered, endorsed, or sponsored by Boulevard or any of its subsidiaries.

The Boulevard name and logos are trademarks or service marks of Boulevard Labs, Inc. or its affiliates in the U.S. and other countries. Other names may be trademarks of their respective owners.

3. Impermissible Uses of Boulevard Marks You may not display, copy, modify, transmit or otherwise use the Boulevard Marks except as described in this Agreement, the Guidelines, or otherwise agreed in writing by Boulevard. You may not use the Boulevard Marks to show Boulevard or the Services in any disparaging or derogatory light, or in any way that may be damaging to our brand or to our interests in the Boulevard Marks.

You may not use the Boulevard Marks to imply endorsement by Boulevard of your products or services, or in a manner that causes customer confusion. You may not misrepresent your relationship with Boulevard, or use the Boulevard Marks in any manner that is misleading. In addition to any other right that we may have to enforce the terms of this Agreement, you must promptly comply with any request that we make for you to cease a use of the Boulevard Marks that we determine is non-compliant with this paragraph.

In addition to protecting the Boulevard Marks, it is important to us that you maintain an independent brand. Even where use of Boulevard Marks is permitted, we suggest that you prominently use your own marks in a manner that makes your brand or any other descriptor of your goods/services clearly distinguishable from that of Boulevard’s. For example, “Commission Calculator for Boulevard” or “Business Analytics powered by Boulevard” are acceptable and emphasize your brand; but “Boulevard Analytics”, “Boulevard for Businesses”, or “Boulevardlytics” are unacceptable and emphasize the Boulevard Marks. You may not use the Boulevard Marks or any confusingly similar name or trademark with your product, service, company, or domain name. For instance, you may not use names like “Boulevard Business Services”, “Boulevard for Platforms” or domains like “getboulevard.com.”

4. No Warranties As part of this Agreement, we do not make any representations regarding your use of Boulevard Marks. We disclaim all warranties, express and implied, including any warranties of non-infringement.

5. Other Legal Provisions Except as otherwise agreed upon in writing between you and us, this Agreement is the entire agreement between you and us regarding your use of the Boulevard Marks. We may terminate this Agreement at any time upon notice to you. You may not transfer this Agreement to any third party. This Agreement is governed by the laws and dispute provisions specified in the Terms of Service, which are incorporated into this Agreement by reference. If any provision or portion of this Agreement is held to be invalid or unenforceable, then it will be reformed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and all remaining provisions will continue in full force and effect.

Trademark Usage Guidelines

Boulevard’s trademarks and brands are Boulevard intellectual property and are among our most valuable assets. In order to preserve and protect these brands, it is essential that they are used properly. Follow these Guidelines and our Brand Style Guide for using Boulevard’s trademarks and brands properly in all communications, documents, and electronic messages.

These Guidelines apply to Boulevard employees, customers, partners, licensees, outside vendors, and other third parties. If you are a Licensee of a Boulevard trademark or logo, your license agreement may have particular usage guidelines different than provided here. If so, please follow the specific guidelines in your agreement. If you are a Licensee but have not been provided with special guidelines for usage of Boulevard brands, then these Guidelines apply to your usage of Boulevard brands.

Specific Do’s and Don't’s

Trademark Notices

Properly designate the status of Boulevard’s trademarks by using the correct trademark symbol (with ®, or ) reflecting Boulevard’s ownership of particular marks as set forth below. Also include an attribution of Boulevard’s ownership in the following format: “_ is a trademark of Boulevard Labs, Inc.” The  or  Symbol should be prominently displayed in conjunction with any Boulevard Mark being used, unless otherwise directed by us to use the ® symbol. All Boulevard Marks used should directly hyperlink to the Boulevard home page located at joinblvd.com.

  • In letters, memos, press releases, white papers, advertising, slides, foils, video, and other multimedia presentations:

  • Properly designate (with ®,, or ) all of Boulevard’s trademarks at the most prominent use (usually a headline) and again on the first occurrence in copy; and

  • In the case of presentation graphics, trademarks should be designated with the proper trademark symbol on each page, slide, and foil.

  • In newsletters, magazines, and publications containing multiple articles:

  • Properly designate (with ®,, or ) all of Boulevard’s trademarks on the first occurrence in the document, in headlines and on the first occurrence in every article in which they are used.

  • In brochures, annual/quarterly reports, books, technical documentation, and other bound documents:

  • Properly designate (with ®, , or ) all of Boulevard’s trademarks on the first occurrence in the document, in headlines, and on the first occurrence in text.

  • In all charts or graphs, properly designate trademarks (with ®,,or ).

  • On all packaging, always use the trademark symbol in every reference.

Syntax for Trademarks

Use the Boulevard trademarks only as adjectives followed by the appropriate generic product or service noun describing the relevant product or service (e.g., “the Boulevard® booking platform rocks”). Boulevard trademarks should not be used in plural or possessive form or as verbs.

References to Company

When Boulevard is used to refer to our company, Boulevard Labs, Inc., rather than as a brand of product or services, then the rules for proper usage change slightly. Unlike trademarks, company names are proper nouns; they can be used in the possessive form and do not need to be followed by a generic term. Neither the ™ nor ® symbol should accompany references to Boulevard as a company. Example:

Correct: Boulevard is now offering its customers more choices than ever. Incorrect: Boulevard® is now offering its customers more choices than ever.

Ownership Assertion

Do not assert rights over any Boulevard brand whether by incorporating a Boulevard brand into your own product or service names, trademarks, logos, company names, or domain names or seeking a trademark or domain name registration for any term that includes a Boulevard brand.

Boulevard Logo Use

Do not make unlicensed use of Boulevard logos, such as the B logo listed below. Third party use of Boulevard logos requires a license or written permission from Boulevard. If you are interested in obtaining a license to use a Boulevard trademark or logo, contact us to discuss your proposed use.

Style of Use

When using Boulevard’s trademarks: (i) follow the style and usage guidelines available in our Brand Style Guide; (ii) use our Logos exactly as they appear here, and do not alter or distort their appearance in any way, for example, by adding your own design elements or changing the font, colors, or size; (iii) allow for clear space around our Logo; and (iv) maintain the legibility of our Logos and keep them sharp, clear, and well-produced. When using our Word Marks, you may not change their appearance by abbreviating them, incorporating them into acronyms, changing their spelling, using them in parts, or using improper capitalization.

No Trademark Bidding

Unless expressly permitted in an agreement between you and Boulevard, you may not bid on a Boulevard trademark (or any variant or extension thereof) as a keyword on any search engine.

No Tarnishment

You may not use a Boulevard trademark in a disparaging or degrading manner.

The following is an illustrative, non-exhaustive list of logos, trademarks, and service marks owned by Boulevard. Because this list of logos and trademarks and their status could change over time, including as we add new products and services, please review this section in these Guidelines periodically. Please note that the absence of a product or service name or logo from the list below does not constitute a waiver of Boulevard’s trademark or other intellectual property rights in that name or logo.
