Boulevard Refer-a-Friend Program Terms
The Boulevard Refer-a-Friend Program (the "Program") is open only to current Boulevard customers. To be eligible to refer, you (the "Referrer") must, at the time of referral and at the time the reward is issued: (i) be associated with a business that has an active Boulevard dashboard; (ii) be a named user on that active dashboard; and (iii) be located in the United States, and associated with a salon, spa, medspa, or other appointment-based, self-care business. Boulevard employees, contractors, affiliates, and their immediate family members are not eligible to participate.
A referral will be considered a "Qualified Referral" only if all of the following are true at the time of submission and at the time the reward would be paid:
The referred business is not already an existing lead or contact in Boulevard's systems and has not been a lead or contact within the prior fifteen (15) days.
The referred business is not affiliated with, owned by, or operated by any company, parent entity, or individual that is already a Boulevard customer, and is not another location, brand, franchise, or entity of the Referrer's own business.
The referral is submitted through the official Boulevard referral link or referral form. Referrals submitted through any other channel will not be credited.
The referred business becomes a paying Boulevard customer and pays its first invoice in full, and its account remains in good standing at the time the reward is issued.
Referrer disclosure obligations. The Referrer agrees that any recommendation or endorsement of Boulevard made to a prospective referral will clearly and conspicuously disclose the Referrer's material connection to Boulevard (i.e., that the Referrer may receive compensation if the recipient signs up), consistent with the Federal Trade Commission's Endorsement Guides (16 C.F.R. Part 255). The Referrer will not engage in spam, bulk or unsolicited commercial messaging, or any communication that violates applicable law, including the CAN-SPAM Act and the Telephone Consumer Protection Act.
Reward and Gift Card. The reward for each Qualified Referral is the reward described in the Refer-a-Friend Program landing page and will provided as virtual gift card (the "Gift Card"), issued to the Referrer within six (6) months after the end of the calendar month in which the referred business pays its first Boulevard invoice in full. The Gift Card is a promotional/award gift card issued at no cost to the Referrer in connection with Boulevard's referral award Program; it is not purchased, is not a general-use prepaid card, and has no cash value except as required by applicable law. The Gift Card must be redeemed within sixty (60) days after the date of issuance, and the expiration date and any applicable fees will be clearly disclosed to the Referrer at the time of issuance. If the Gift Card is not redeemed by the expiration date, it will expire and will not be replaced, reissued, refunded, or substituted with cash or credit, and Boulevard will have no further obligation with respect to it. The Gift Card is non-transferable, is not reloadable, cannot be resold, and cannot be combined with other Boulevard offers. Boulevard is not the issuer of the Gift Card; use of the Gift Card is subject to the terms and conditions of the Gift Card issuer, and Boulevard is not responsible for lost, stolen, damaged, expired, or unused Gift Cards. Where any provision of this section is prohibited or restricted by the law of the Referrer's jurisdiction (including state laws governing gift card expiration or fees), the Gift Card will be governed by that applicable law to the minimum extent required, and the remaining provisions will continue in full force and effect.
Combination with other offers. The Program cannot be combined with other Boulevard promotional offers unless Boulevard expressly permits it in writing or in the terms of the other offer.
Changes to the Program. Boulevard may terminate, suspend, replace, or modify the Program, including the reward amount, form of reward, and Gift Card terms (subject to the disclosure requirements in the Reward and Gift Card section above), at any time in its sole discretion. Any such change will apply prospectively only: it will not reduce or revoke a reward that has already been earned, and for Qualified Referrals submitted through the referral link or referral form before the effective date of the change, the reward amount and form in effect at the time of submission will apply, provided the referral otherwise qualifies. Boulevard may also disqualify any referral, withhold or reverse any reward, and suspend or terminate a Referrer's participation, if Boulevard determines in its reasonable discretion that the referral was fraudulent, duplicative, submitted in bad faith, or in violation of these terms or applicable law, or if the referred business's account is refunded, charged back, canceled, or not in good standing during the earning window.
Taxes and reporting. Taxes and any reporting obligations associated with receipt of the reward are the sole responsibility of the Referrer. Boulevard may require a completed IRS Form W-9 (or equivalent) before issuing any reward, and will issue a Form 1099 where required by law.
General. Participation is void where prohibited or restricted by law. Participation does not create any employment, agency, partnership, or joint venture relationship between the Referrer and Boulevard. Participation in the Program is governed by Boulevard's Main Service Agreement and Privacy Policy, which are incorporated by reference. In the event of a conflict between these Program terms and the above, these Program terms control with respect to the Program.
