Let’s talk privacy. 

Boulevard Labs, Inc. (“Boulevard,” “we,” “our,” or “us”) hosts a website and provides appointment booking, scheduling, and customer engagement technology and platforms (together, the “Services”) to third-party self-care businesses with a Boulevard account (our “Customers” ) who use Boulevard Services to publish, offer, and collect payment for services they provide to their clients (“Clients”), who can search for, book, and purchase Customers’ products and services (“Offerings”).

This Privacy Policy describes how Boulevard collects, uses, discloses, and protects the personal information collected from and about individuals in the following ways:

  • through our website, https://www.joinblvd.com/, and any other website or online property operated by Boulevard where this Privacy Policy is posted or linked;

  • in connection with Boulevard’s business development, marketing, and sales activities; and

  • through our offline and in-person business interactions, including at events, conferences, and other Boulevard-sponsored activities.

(collectively, our “Designated Services”).

In this Privacy Policy, “personal information” refers to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual and includes “personal data” or similar terms as defined in applicable law.  Personal information does not include information that is de-identified or aggregated so that it will no longer be considered personal information.

Note: This Privacy Policy does not apply to personal information that we collect or receive on behalf of our Customers from their clients (“Clients”). We process Client Personal Information as a service provider on behalf of our Customers, and such processing is subject to our Customers’ respective privacy policies. Personal Information We Collect

Personal Information You Provide to Us

We receive and store any personal information you provide to us, including:

  • Account information, including the account information that you use to register for and access the Designated Services.

  • Audio, electronic, visual, or similar information, including phone call recordings, and profile photographs. 

  • Contact information, including your name, email address, business name, business website, street address, and telephone number.

  • Preferences, including how frequently you wish to receive marketing and promotional communications from us.

  • Other personal information you choose to provide, including information you include in any forms or surveys that you complete and submit to us, and other information that you provide during your interactions with us, such as support or sales inquiries.

Personal Information Collected Automatically

Whenever you interact with our Designated Services, we automatically receive and record the following information on our server logs from your browser or device:

  • Internet or other electronic network activity information, including information regarding your interactions with the Designated Services. This includes:

    • Computer or Device Information, which includes the Internet Protocol (IP) address and/or other unique identifier(s) assigned to your device, the location of your device, and other information about your browser, device, and operating system.

    • Usage Information, which includes information about your interaction with and use of the Designated Services (e.g., the date and time of your visit(s); the areas or pages that you visit; the amount of time you spend viewing or using the Designated Services; the domain name from which you accessed the Website, and other clickstream or site usage data.

  • Geolocation data, in an imprecise format, such as coarse location derived from an IP address.

Cookies and Related Technologies

To improve our Designated Services and customize your online experience, we (and our service providers and partners) may use cookies, device, fingerprinting, or other similar technologies to collect data about your usage of the Designated Services and the actions that take upon receipt of an email from us (collectively, “cookies”). Through cookies, we may also automatically collect information about your online activity after you leave our Designated Services. This information allows us to improve the Designated Services and customize your online experience, and otherwise as described in this Privacy Policy.

Cookies may be necessary for the basic functionality of the website as well as other purposes. You have the option of disabling certain types of cookies, though doing so may impact your experience on the website.

We use the following types of cookies on our Designated Services:

Essential

These cookies are essential for us to operate the Designated Services. For example, these cookies are used to ensure the security of the Designated Services, to detect abuse, or to enable you to stay connected to our Designated Services. The Designated Services will not work if you disable essential cookies.

Targeted Advertising

These cookies are used to deliver advertising that is relevant to you and your interests, limit the number of times you see a particular advertisement, and measure the effectiveness of our advertising campaigns.

These cookies allow the Designated Services to remember choices you make (such as your username, language, or the region you are in) and provide enhanced, more personalized features. Disabling these cookies will result in a less personalized experience when using the Designated Services.   

Analytics

These cookies allow us to monitor and assess how the Designated Services are performing and where they can be improved. For example, we use these cookies to test different versions of our Designated Services to learn which features or content you prefer. We also use these cookies to analyze how people access and use our Designated Services.

We may allow certain service providers to place third-party cookies and use similar technologies on our Designated Services for purposes of analyzing performance, including collecting information about your online activities over time and across different websites, applications, and/or devices. These cookies are subject to such third parties’ cookies and/or privacy policies. For instance, to help us better understand how people engage with the Designated Services, we work with third-party analytics partners, including Google Analytics. Like many services, Google Analytics uses cookies to track user interactions. In our case, these cookies are used to collect information about how users use our Designated Services. This information is used to compile reports, which disclose trends without identifying individual visitors, and help us improve our Designated Services. We may also obtain information from our email newsletters or other communications we send to you, including whether you opened or forwarded a newsletter or clicked on any of its content. This information tells us about our newsletters’ effectiveness and helps us ensure that we are delivering information that you find interesting.

Referral Information. If you participate in our Refer-a-Friend Program (or any similar referral or advocacy program we offer), you may submit personal information about another individual, including their name, email address, phone number, U.S. zip code, business name, and business website. By submitting a referral, you represent and warrant that (i) you have a direct, personal or professional relationship with the referred individual, (ii) you are authorized to share their information with us for this purpose, and (iii) the referred individual would reasonably expect that you might refer them to a provider like Boulevard.

Information collected from other sources

We may obtain personal information about you from third parties, such as social media platforms, data brokers, and, if you are referred to Boulevard, the individual who referred you (for example, through our Refer-a-Friend Program). 

We use the personal information that we receive from other sources to help us maintain the accuracy of or supplement the information we collect, with the Designated Services, conduct internal business analysis, and fulfill other business or commercial purposes described in this Privacy Policy.

Combination of information

We may combine the personal information that we collect from and about you, including information you provide to us, the information we automatically collect through the Designated Services, and information we receive from third-party sources, and use the combined information for the purposes described in this Privacy Policy.

Notice of Financial Incentives: Refer-a-Friend and Similar Programs

Boulevard offers certain referral programs in which existing customers may receive a gift card, credit, discount, or other benefit for referring new prospective customers to Boulevard. When you participate in a referral program, Boulevard may collect personal information about the referred prospect (such as name, email address, phone number, U.S. zip code, business name, and business website) in connection with that referral. In exchange for your referral, you receive a financial incentive. We estimate the value of such personal information based on our average cost to acquire a comparable prospective customer through our paid marketing channels. Participation is voluntary and requires your affirmative opt-in by submitting a referral; you may withdraw from any referral program at any time, and withdrawal will not affect the services or pricing you receive from Boulevard. How We Use Personal Information 

We use the personal information we collect for the following purposes:

Providing the Designated Services

  • Including to operate, maintain, support, and provide the Designated Services.

  • Communicating with you, including to contact you for administrative purposes (e.g., to provide services and information that you request or to respond to your comments and questions) or to send you important updates and communications about this Privacy Policy and/or other applicable terms and conditions

  • Answering requests for customer or technical support

  • Processing your financial information and other payment methods for products or Designated Services purchased

  • Conducting analytics and developing products, including to analyze usage trends and preferences in order to improve the Designated Services and to develop new products, services, and features

  • Using artificial intelligence and machine learning, including to identify prospective customers and business opportunities, and develop and improve our products, services, and marketing

Marketing and Advertising

  • Personalizing the Designated Services, including to tailor the content we may send or display to you and otherwise personalize your experience with us

  • Sending you marketing and promotional communications, including messages about promotions, events, products, or services that we think may interest you 

  • Engaging in advertising and marketing, including to serve you advertising on other online services across the devices you may use 

  • Operating our referral and advocacy programs, including to verify that a submitted referral qualifies under the applicable program rules, to contact referred businesses about Boulevard's products and services, to issue and administer referral rewards, to prevent fraudulent or duplicate referrals, and to comply with tax reporting obligations in connection with referral rewards

Other Administrative Purposes

  • Ensuring internal quality control and safety

  • Authenticating and verifying individual identities, including requests to exercise your rights under this Privacy Policy

  • Debugging to identify and repair errors with our Designated Services

  • Maintaining security and preventing fraud, including to monitor and maintain the security of our systems and networks, and to detect, prevent, investigate, and protect you, our business, and others from fraud, unauthorized transactions, and other unlawful or unsafe activity

  • Satisfying our legal obligations, including complying with applicable law and responding to lawful requests and communications from law enforcement authorities and other government officials

  • Supporting our business operations and business transactions, including to administer our general business, enforce our agreements and policies, and other related functions, and to carry out sales or other business transactions (i.e., we may choose to buy or sell assets)

Additionally, we will use your personal information as described to you at the point of information collection or with your consent. We will also use your personal information as we believe necessary or appropriate to protect our rights, privacy, safety, property, and/or those of others.

How We Disclose Personal Information 

We may disclose personal information to the following categories of recipients:

  • Affiliated Businesses. We may disclose your personal data to our affiliates.

  • Advertising and Marketing Partners. We disclose personal information to our marketing and advertising partners, including social media networks, third-party advertising networks, and other parties that assist us in serving and optimizing our advertisements or working with us in connection with our marketing efforts. This includes sharing information with advertising partners to develop lookalike audiences of prospective customers and to build exclusion lists of existing or former customers so we avoid targeting them with new-prospect advertising. 

  • Analytics Partners. We disclose your personal information to our partners that assist us in performing analytics and help us measure the effectiveness of the Designated Services and our marketing and advertising efforts.

  • Business Partners. We disclose your personal information to other companies with whom we partner to provide services or other offerings to you and carry out other related activities.

  • Service Providers. We employ other companies and people to perform tasks on our behalf and need to share your personal information with them to provide products or services to you. For example, we may use a payment processor to receive and process credit card transactions.

  • To Comply with Legal Obligations. We may access, preserve, and disclose your personal information or other account information if we believe doing so is required or appropriate to (i) comply with laws, law enforcement requests, and legal process, such as a court order or subpoena; (ii) respond to your requests; or (iii) protect your, our, or others’ rights, property, or safety.

  • Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction as well as in the event of any insolvency, bankruptcy, or receivership in which data is transferred to one or more third parties as one our business assets.

  • Other Parties. We will disclose your personal information to other parties with your consent or at your direction. Additionally, we will disclose your personal information to other parties as we believe necessary and/or appropriate either to: (i) comply with applicable law; (ii) protect our operations and those of our affiliates and subsidiaries; (iii) investigate and prevent against fraud; (iv) protect our rights, privacy, safety, property, and/or those of others; or (v) allow us to pursue available remedies or limit damages that we may sustain.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates for marketing or promotional purposes.

Additionally, we may de-identify, anonymize, or aggregate personal information and disclose such information to third parties for purposes as permitted by law.

Your Choices

We provide you with the ability to make certain choices about how we use your personal information, as described below.

  • Marketing and Promotional Communications: You can opt out of receiving marketing and promotional communications from us at any time by following the instructions included in any marketing or promotional communications that you receive from us. Please note that even if you opt out of receiving marketing and promotional communications from us, you will still receive non-marketing or transactional messages from us, including messages about your account and responses to your inquiries/requests.

  • Cookies

    • As noted above, we (and our third-party providers and partners) use cookies on the Designated Services for various purposes. You may set your cookie preferences on our Designated Services through the “Cookie Preferences” link in the footer of our websites. 

    • You may also be able to adjust your device or browser settings to limit certain tracking or to decline cookies. Please refer to your device’s settings or your Internet browser’s “Help” section for more information on how to delete cookies and/or disable your device or browser from receiving cookies or adjust your tracking preferences. Note that if you disable cookies, some features on the Designated Services may not function properly.   • Targeted Advertising Opt-Out. To opt out of targeted advertising, please do so by unselecting advertising cookies within the “Cookie Preferences” link in the footer of our websites.

  • Other Analytics/Advertising Opt-Outs. 

    • Some of our advertising partners may provide you with additional choices with respect to interest-based advertising. For example, certain social media platforms may allow you to control your advertising preferences directly through their services. Please review the privacy policies of the third-party services you use for more information.

    • If you wish to prevent your data from being used by Google Analytics, Google has developed the Google Analytics opt-out browser add-on available at https://tools.google.com/dlpage/gaoptout.

Please note that you will need to opt out separately on all of your browsers and devices, as each opt-out will apply only to the specific browser or device from which you opt out. If you delete or reset your cookies, change browsers, or use a different device, preferences may not be saved, and you will have to opt out again. 

Privacy Rights 

Depending on where you are located, you may have the right to:

  • Access to Data: You may request a copy of personal information we have about you in a portable format and/or request us to transfer all or some of this data to a third party.

  • Correction of Data: You may request that we update, correct, or rectify personal information we have about you.

  • Deletion of Data/Account Deletion: You may request that we delete personal information we have about you. 

  • Restriction of or Object to Processing: You may have the right to opt in or opt out of certain uses of your personal information, or to object to all processing of your personal information, or to withdraw consent you previously gave for the processing of your personal information.

  • Supervisory Authority: If you are located in the European Economic Area, Switzerland, the United Kingdom, or Brazil, you have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

Security 

We maintain administrative, technical and physical safeguards that are intended to appropriately protect personal information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the personal information in our possession. 

Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any personal information you provide to us. Please be sure to protect your password and/or other sign-on mechanism and limit access to your computer or device by signing off after you have finished accessing your account. 

Data Retention

We generally retain personal information for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, financial, or reporting obligations, to establish or defend legal claims, or for compliance and protection purposes.

To determine the appropriate retention period for personal information, we may consider factors such as:

  • The amount, nature, and sensitivity of the personal information

  • The impact to the Designated Services, including the possibility for re-enrollment with the Designated Services

  • The potential risk of harm from unauthorized use or disclosure of your personal information

  • The purposes for which we process your personal information

  • Whether we can achieve those purposes through other means

  • Applicable legal requirements, including mandatory retention periods, statutes of limitation, legal holds, and litigation requirements

When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.

Note that in some cases, even if you submit a data deletion request, we may be required to retain your personal information, such as to comply with the law; maintain records of transactions; exercise, establish, or defend legal claims; or protect against fraud or abuse of our systems.

Third-Party Websites

This Privacy Policy applies only to the processing of your personal information by Boulevard. The Designated Services may contain links to third-party sites, such as third-party content providers (“Third-Party Sites”). The policies and procedures described in this Privacy Policy do not apply to Third-Party Sites. The links from the Designated Services to any Third-Party Sites do not imply that we endorse or have reviewed the Third-Party Sites or their privacy practices.

Children’s Privacy 

We do not knowingly collect or solicit personal information from anyone under the age of 18. If you are under 18, please do not attempt to register for the Designated Services or send any personal information to us. If we learn that we have collected personal information from a child under age 18, we will delete that information as quickly as possible. If you believe that a child under 18 may have provided us personal information, please contact us as described below.

Updates to this Privacy Policy

We’re constantly seeking to improve our Designated Services, so we may need to change this Privacy Policy from time to time, but we will alert you to changes by displaying a notice on the Designated Services, by sending you an email, and/or by some other means.

Please note that if you haven’t provided us with your email address, the revised version of this Privacy Policy will still govern your use of the Designated Services, and you are still responsible for reading and understanding it. If you use the Designated Services after any changes to this Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect now is subject to version of this Privacy Policy in effect at the time such information is used.
